Terms and Conditions of Sale

The following conditions apply to all purchases made on the website www.theca.it and must be read and expressly approved by the customer before completing any purchase, under penalty of nullity of the same. THECA Astucci S.r.l. reserves the right to modify these terms and conditions at any time.

VALIDITY OF CONDITIONS

The supply conditions indicated herein apply exclusively to the Italian market.

IMAGES AND DESCRIPTIONS

Images are for illustrative purposes only. Product photos are as accurate as possible; however, they may differ from the actual product received, for example in color, shape, or size.
For better presentation of the products offered, some images may be reduced and therefore not shown at a 1:1 scale.
All product descriptions published in the online catalog are as accurate and up-to-date as possible.

ORDER ACCEPTANCE

The order submitted by the Customer is received by THECA Astucci S.r.l., which will send an immediate confirmation of receipt via e-mail. THECA Astucci S.r.l. reserves the right to accept the order, in whole or in part, and will provide formal confirmation to the Customer by fax or e-mail in case of changes or issues. Orders will be processed only upon compliance with the agreed payment terms, which are implicitly accepted by the Customer at the time of order submission. Orders are considered accepted only after the Seller has sent the Customer an e-mail confirming receipt and acceptance of the order, and the Customer has duly received it, unless otherwise provided below.
If a shipping address different from the residential address provided during registration is requested, or in any other case where deemed necessary, the Seller reserves the right to condition acceptance of the order upon verification of the Customer’s residence and/or identity data, in certain cases requiring the transmission via fax or e-mail of appropriate supporting documentation (such as ID card, credit card, etc.). Ownership of the shipped goods remains with the Seller until full payment of the total amount, including VAT (where applicable) and any additional charges.

PRICES, VAT AND INVOICING

All prices are expressed in Euro, exclusive of VAT, and include appropriate packaging. For each shipment, an invoice and accompanying document are issued, valid for warranty purposes and as proof of purchase, also in relation to the exercise of the right of withdrawal.

AVAILABILITY

THECA Astucci S.r.l. undertakes to dispatch ordered items that are available in stock as soon as possible, and in any case within a few working days from order confirmation.

SHIPPING AND INSURANCE

Shipping costs are borne by the Customer, calculated based on the weight and destination of the purchased products, and are duly invoiced to the Customer. The shipping address is the one indicated by the Customer at the time of the online purchase, unless otherwise agreed in writing between the parties.
Goods travel at the Supplier’s risk until delivery to the address indicated by the Customer.

THECA Astucci S.r.l. accepts the following payment methods:

CLAIMS, RETURNS AND RIGHT OF WITHDRAWAL (pursuant to Articles 52–59 of Italian Legislative Decree 206/2005)

The Customer has the right to withdraw from the contract without penalty within 14 (fourteen) days of receiving any product sold on the website. Returned products must be sent back in the exact same condition as they were shipped to the Customer. To return the purchased goods subject to withdrawal, the Customer must notify their intention to withdraw from the purchase within the aforementioned period, providing a reason for the request. This communication may be sent by e-mail to [email protected]. THECA Astucci S.r.l. will then authorize the return shipment, without such authorization constituting implicit acceptance of the return, which will only be confirmed after inspection and verification of the returned items. The shipping method must be agreed and approved via e-mail with THECA Astucci S.r.l. THECA Astucci S.r.l. will refund the amounts paid by the Customer within 30 working days of receipt of the returned goods by bank transfer, to the account indicated by the Customer when notifying their withdrawal. Other refund methods may be agreed upon depending on the circumstances.

RETURN CONDITIONS

The right of withdrawal applies only to intact and non-personalized products, returned:
- complete with all accessories and original packaging;
- in perfect condition, without signs of use or damage.
The right of withdrawal cannot be exercised for:
- customized or made-to-order products requested by the Customer (e.g. boxes, displays, ribbons, shoppers with specific logos or finishes);
- damaged or used items that compromise resalability.

SHIPPING COSTS

In the event of withdrawal:
- return shipping costs are borne by the Customer;
- initial shipping costs incurred by THECA Astucci S.r.l. are non-refundable, even if previously indicated as “free”, unless otherwise stated in writing.
The refund will cover only the amount of the purchased product, net of shipping costs.

DEFECTIVE OR NON-CONFORMING PRODUCTS

In the event that the Customer receives a damaged, defective, or non-conforming product, THECA Astucci S.r.l. will, after verification:
- replace the item free of charge, or
- fully refund the amount paid, including shipping costs.

FINAL NOTES

THECA Astucci S.r.l. reserves the right to refuse returns that do not comply with the above conditions or are sent beyond the allowed timeframe.

JURISDICTION

For any dispute arising between the parties that cannot be resolved amicably, the competent court shall be that of Alessandria (Italy).
